Terms of Service & Refund Policy

1. Agreement to these Terms

These Terms of Service ("Terms") govern your purchase and use of TJS Design's website plans and care plans (together, the "Services").

"TJS Design" is a brand/trade name used by Trevor Jared Spencer, an individual operating as a freelancer — not a separate registered company. Any contract for Services is directly between you (the "Client") and Trevor Jared Spencer personally. By checking the agreement box at checkout, purchasing, or using the Services, you agree to these Terms. See our Privacy Policy for how we handle your information.

Clients who purchased before October 30, 2026 keep the terms they agreed to at the time of purchase.

2. Plans

Every website plan starts with a 12-month agreement (the "Initial Term") that begins on the date of your first payment. Each plan includes the same Services; the plans differ only in how you pay:

• Own It — $999.99 upfront plus $29.99 per month for 12 months.
• Balanced — $499.99 upfront plus $79.99 per month for 12 months.
• Zero Down — $0 upfront plus $129.99 per month for 12 months.

During the Initial Term, every plan includes: a custom website built and launched (typically within 14 business days of your intake call); hosting, security, updates and uptime monitoring; content changes; up to one (1) 30-minute call per month; support by phone, text and email; and one branded post to your Google Business Profile each week (up to 52 per year). Unused calls don't carry over. Weekly posts require access to your Google Business Profile; we write them, and you're welcome to send photos or topics anytime.

After the Initial Term, your plan continues month-to-month on one of two care plans:

• Essential Care — $29.99 per month, month-to-month. Includes hosting, security and uptime monitoring, weekly Google Business Profile posts, up to three (3) small edits per month, and text and email support during business hours.
• Premium Care — $79.99 per month, month-to-month. Includes everything in Essential Care plus up to one (1) 30-minute call per month, larger content changes, and 24/7 support by phone, text and email.

You'll be enrolled in Essential Care at $29.99 per month automatically when your Initial Term ends, unless you ask us to upgrade you to Premium Care or to cancel. You can move between Essential Care and Premium Care at any time by text, call or email; the new rate starts with your next monthly charge. Care plans are offered month-to-month only. Prices shown at checkout are the prices that apply to your order.

3. Payment & Card on File

All payments are processed securely through Stripe. We do not see or store your full card number. At checkout you pay the upfront amount (if any) plus your first monthly payment, and you authorize TJS Design to keep your card on file and charge it automatically for each remaining monthly payment in the Initial Term and for any care plan afterward, until you cancel as described below.

Stripe emails you a receipt for every charge, a reminder before a card on file expires, and a notice with a secure link to update your card if a payment fails. If a payment can't be collected, we may pause the Services (including taking the website offline) until the balance is paid.

4. Automatic Renewal & Cancellation

Canceling during the Initial Term. You can ask us to stop the Services at any time, but because the website build is paid for over the 12-month Initial Term, the remaining Initial Term payments are still due. We'll continue charging them on schedule, or you may pay the remaining balance in one payment.

Canceling a month-to-month care plan. You may cancel anytime before your next charge by text or phone at (385) 472-3690 or by email at trevorspencer89@gmail.com. Cancellation stops all future charges; no further payments are taken after your cancellation is received.

5. Refund Policy

Upfront payments cover design and development work and are non-refundable once paid, regardless of project stage or whether you ultimately use the completed site. Monthly payments are non-refundable once charged, and we don't provide partial refunds or proration for part of a month. Nothing in this policy limits any rights you may have under applicable law.

6. Project Timeline & Your Responsibilities

We guarantee delivery of your website within 14 business days of your intake call, on our end. This timeline depends on you being reasonably responsive to design review requests and providing requested materials (logo, photos, account access, etc.) in a timely manner. Extended periods without a response from you may push back the delivery date accordingly.

7. Domains & Third-Party Costs

Your domain name is purchased separately, directly by you, through a registrar of your choice — it stays in your name and belongs to you. Hosting is included in your plan. Other third-party costs (for example paid ads, premium plugins or booking software) are not included unless we've agreed otherwise in writing.

8. Confidentiality

Anything you share with us about your business — including revenue, financial performance, customer information, or other proprietary or sensitive business details — is kept confidential and is not shared with other clients, contractors, or third parties, except where required by law. 9. Ownership

Once all payments for your Initial Term have been made, you own the final website delivered to you, and on request we'll hand over its files so you can host it anywhere. Until then, the website remains ours, and we may take it offline if payments stop. We may showcase the design in our own portfolio (as we do for all client work) unless you ask us not to.

10. No Guarantee of Results

We build and design your website to a professional standard, but we don't guarantee specific business outcomes — like a particular amount of traffic, leads, sales, or search ranking — as these depend on many factors outside our control.

11. Limitation of Liability

To the fullest extent permitted by law, TJS Design's total liability for any claim related to the Services is limited to the amount you paid for the Services giving rise to the claim. We are not liable for indirect, incidental, or consequential damages (such as lost profits or lost business).

12. Termination

We reserve the right to decline, pause, or terminate a project or plan — for example, in cases of non-payment, abusive conduct, or a request to build something illegal or that violates third-party rights. If we terminate a Website Build project before delivery for reasons other than your breach of these Terms, we'll discuss a fair resolution with you directly.

13. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above. Continuing to use the Services after changes means you accept the updated Terms.
