Terms of Service & Refund Policy

1. Agreement to these Terms

These Terms of Service ("Terms") govern your purchase and use of website build services and the optional Site Management plan (together, the "Services") offered by TJS Design.

"TJS Design" is a brand/trade name used by Trevor Jared Spencer, an individual operating as a freelancer — not a separate registered company. Any contract for Services is directly between you (the "Client") and Trevor Jared Spencer personally. By purchasing or using the Services, you agree to these Terms. 2. The Services

• Website Build — a custom-designed website, delivered as a one-time project for a flat fee, typically within 14 business days of your intake call.
• Site Management plan — an optional, ongoing subscription (billed monthly or annually, your choice) covering updates, monitoring, and support after your site launches. This is optional — your site is fully functional and live without it.

Current pricing for both is shown at checkout on our site; the price you're shown and agree to at checkout is what applies to your order.

3. Payment

All payments are processed securely through Stripe. We do not see or store your full card number. Payment for the Website Build is due in full to begin the project. Site Management plan charges recur automatically each billing period (monthly or annual, depending on what you select) until canceled.

4. Refund Policy

Website Build (one-time payment). Because this payment is for the design and development work performed on your project, all Website Build payments are final and non-refundable once paid, regardless of project stage or whether you ultimately use the completed site.

Site Management plan, billed annually. If you choose annual billing, your full annual payment is also final and non-refundable once charged — the same as the Website Build. If you cancel partway through your paid year, the plan simply will not renew; we don't refund the unused portion. Your Site Management service continues through the end of the term you've already paid for.

Site Management plan, billed monthly. If you choose monthly billing, you may cancel at any time. Canceling stops all future billing — you will not be charged again after your cancellation date. The payment for any billing period that has already been charged is final and non-refundable; we don't provide partial refunds or proration for the remainder of a month you've already been charged for.

5. Project Timeline & Your Responsibilities

We guarantee delivery of your Website Build within 14 business days of your intake call, on our end. This timeline depends on you being reasonably responsive to design review requests and providing requested materials (logo, photos, account access, etc.) in a timely manner. Extended periods without a response from you may push back the delivery date accordingly.

6. Domains & Third-Party Costs

Your domain name is purchased separately, directly by you, through a registrar of your choice — it stays in your name and belongs to you. Hosting and any other third-party costs disclosed to you separately are not included in the Website Build or Site Management price unless we've told you otherwise in writing.

7. Confidentiality

Anything you share with us about your business — including revenue, financial performance, customer information, or other proprietary or sensitive business details — is kept confidential and is not shared with other clients, contractors, or third parties, except where required by law. 8. Ownership

Once your Website Build is paid in full, you own the final website delivered to you. We may showcase the design in our own portfolio (as we do for all client work) unless you ask us not to.

9. No Guarantee of Results

We build and design your website to a professional standard, but we don't guarantee specific business outcomes — like a particular amount of traffic, leads, sales, or search ranking — as these depend on many factors outside our control.

10. Limitation of Liability

To the fullest extent permitted by law, TJS Design's total liability for any claim related to the Services is limited to the amount you paid for the Services giving rise to the claim. We are not liable for indirect, incidental, or consequential damages (such as lost profits or lost business).

11. Termination

We reserve the right to decline, pause, or terminate a project or Site Management plan — for example, in cases of non-payment, abusive conduct, or a request to build something illegal or that violates third-party rights. If we terminate a Website Build project before delivery for reasons other than your breach of these Terms, we'll discuss a fair resolution with you directly.

12. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above. Continuing to use the Services after changes means you accept the updated Terms.
